Mauritania has not agreed to hand over spy chief
NOUAKCHOTT, Mauritania (AP) ? A senior member of Mauritania's government denied Wednesday the country had agreed to hand over Moammar Gadhafi's ex-spy chief for trial in Libya, directly contradicting the claim hours earlier by Libya which said Mauritania had assured them they will hand over Abdullah al-Senoussi.
The official who is close to the negotiations and who requested anonymity because of the sensitive nature of the discussion told The Associated Press by telephone that "Mauritania has given no assurances whatsoever to Libya regarding handing over al-Senoussi."
He said Libya went ahead with the declaration earlier Wednesday in order to "force Mauritania's hand" and pressure them to hand over al-Senoussi, even though its unclear if he would receive a fair trial in his home country where Gadhafi was killed by the mob that arrested him.
Gadhafi's former intelligence chief is accused of attacking civilians during the uprising in Libya last year, as well as of the 1989 bombing of a French airliner.
Earlier Wednesday, Libyan spokesman Nasser al-Manei told reporters: "The Mauritanian government has given their agreement for the extradition of Abdullah al-Senoussi to Libya so he can be judged by a fair process."
Al-Senoussi showed up at Mauritania's international airport on Saturday, traveling on a fake Malian passport. The court also indicted Gadhafi but the ousted leader was killed by rebel fighters in October, as well as Gadhafi's son Seif al-Islam. Libyans say they want to put both the son and the intelligence chief on trial at home instead of turning them over him to the court.
Libyan officials are currently holding al-Islam, who was arrested in November by fighters in Libya's remote southern desert. The former heir apparent has been held largely without access to the outside world ever since.

Patent law is a form of intellectual property. Last, a plant patent may be granted to someone who ?invents or discovers and asexually reproduces any distinct and new variety of plant.
In order to acquire a patent, a written application has to be filed with the relevant patent office. The application will describe in detail how to make and use the invention. Also, the applicant should include the claims in the application. Claims address what the applicant wants to protect. Expressly stating what the owner wants to exclude others from making, selling, or using. The claims cover ?the scope of the protection?. Upon completion of the application, the patent is pending until it is confirmed that certain requirements have been met.
There are remedies for patent owners whose inventions have been infringed upon. The patent is usually enforced through a civil lawsuit. The inventor or assignee of the patent will ask the court for monetary damages for the infringement and will ask for an injunction to stop all future infringement activity. In order to prove an infringement case, the patent owner must show that the accused infringer engages in all the requirements of one of the claims presented in the patent application. However, courts have often declared patents invalid.
Even more, patent licensing agreements and contracts may be formed where the patent owner agrees not to sue the licensee in return of some form of compensation. Thus, patents can be enforced through litigation in which the defense would be invalidity of the patent or patents can be subject to a licensing agreement.
An infringement does not occur just because a person thinks about an invention. If research is conducted for commercial purposes, rather than ?purely philosophical? reasons, it would be consider an infringement. However, research conducted to obtain approval from the Food and Drug Administration for the production of a generic version of a patented drug is not an infringement.

The intellectual property world is buzzing about the trademark dispute brewing between luxury brand Louis Vuitton and University of Pennsylvania Law School. Louis Vuitton recently sent a strongly worded cease and desist letter demanding that the school remove posters advertising the Pennsylvania Intellectual Property Group?s (PIRG) annual symposium on fashion law because the posters ?misappropriated and modified? Vuitton?s trademarked monogram design.
?This egregious action is not only a serious willful infringement and knowingly dilutes the LV trademarks, but also may mislead others into thinking that this type of unlawful activity is somehow ?legal? or constitutes ?fair use? because the Penn Intellectual Property Group is sponsoring a seminar on fashion law and ?must be experts,?? the letter said.
However, according to many in the IP legal community, Louis Vuitton got it wrong. In his written response, Penn associate general counsel Robert Firestone outlines why PIRG?s poster did not infringe on any of Louis Vuitton?s trademarks.
Firestone first argues that the poster?s artwork is a parody and isn?t being used to identify goods and services. He also raises doubt that Vuitton?s trademark is registered ?to cover educational symposia in intellectual property law issues.? In addition, he argues that there is no likelihood of confusion, given that attendees?law students, fashion executives, and lawyers?are unlikely to believe that the French design house is organizing the event.
Finally, Firestone addresses the issue of trademark dilution, noting that ?[Penn] has not commenced use of the artwork as a mark or trade name, which is a prerequisite for any liability.? He further argues that ?even if [Penn] has used the artwork as a mark, there is an explicit exception to any liability for dilution ? for ?any noncommercial use of a mark.??
Given the reaction to their cease and desist letter, we wonder if Louis Vuitton will reconsider its heavy handed approach in the future.

California's stem cell agency ponders its future
LOS ANGELES (AP) ? The creation of California's stem cell agency in 2004 was greeted by scientists and patients as a turning point in a field mired in debates about the destruction of embryos and hampered by federal research restrictions.
The taxpayer-funded institute wielded the extraordinary power to dole out $3 billion in bond proceeds to fund embryonic stem cell work with an eye toward treatments for a host of crippling diseases. Midway through its mission, with several high-tech labs constructed, but little to show on the medicine front beyond basic research, the California Institute for Regenerative Medicine faces an uncertain future.
Is it still relevant nearly eight years later? And will it still exist when the money dries up?
The answers could depend once again on voters and whether they're willing to extend the life of the agency.
Several camps that support stem cell research think taxpayers should not pay another cent given the state's budget woes.
"It would be so wrong to ask Californians to pony up more money," said Marcy Darnovsky of the Center for Genetics and Society, a pro-stem cell research group that opposed Proposition 71, the state ballot initiative that formed CIRM.
Last December, CIRM's former chairman, Robert Klein, who used his fortune and political connections to create Prop 71, floated the possibility of another referendum.
CIRM leaders have shelved the idea of going back to voters for now, but may consider it down the road. The institute recently submitted a transition plan to Gov. Jerry Brown and the Legislature that assumes it will no longer be taxpayer-supported after the bond money runs out. CIRM is exploring creating a nonprofit version of itself and tapping other players to carry on its work.
"The goal is to keep the momentum going," board Chairman Jonathan Thomas said in an interview.
So far, CIRM has spent some $1.3 billion on infrastructure and research. At the current pace, it will earmark the last grants in 2016 or 2017. Since most are multi-year awards, it is expected to stay in business until 2021.
So what have Californians received for their money so far?
The most visible investment is the opening of sleek buildings and gleaming labs at a dozen private and public universities built with matching funds. Two years ago, Stanford University unveiled the nation's largest space dedicated to stem cell research ? 200,000 square feet that can hold 550 researchers.
There are no cures yet in the pipeline and CIRM has shifted focus, channeling money to projects with the most promise of yielding near-term results. Most of the money early on was funneled toward learning the basics and recruiting scientists.
One researcher lured to California was Paul Knoepfler, a stem cell and cancer expert who was deciding between positions at University of California, Davis and an East Coast school.
"I was getting more interested in embryonic stem cells and I knew California would be a more friendly climate for that," said Knoepfler, whose work focuses on why some embryonic stem cells trigger tumor growths.
Knoepfler favors another bond measure to keep CIRM afloat, but recognizes the average Californian may disagree.
Scientists have prized embryonic stem cells since their discovery over a decade ago because of their potential to transform into any cell of the body. If researchers could harness these flexible cells, they might create replacement tissues to treat diabetes, spinal cord injury and other debilitating conditions.
For all the medical promise that embryonic stem cells hold, the payoff will take years and it's not surprising that there are still no treatments on the market. Their use has been debated because human embryos from fertility clinic leftovers have to be destroyed to harvest the cells.
When Prop 71 was approved, there were limits on federal spending to a small number of cell lines made before 2001. Despite the delay, Noll said CIRM's legacy has yet to be written.
"CIRM spent a lot of money and there's a lot of stuff going on, but it's too early to know whether it was worth it," Noll said.
While CIRM has found its stride, it is a victim of its early supporters' hype, said John Simpson of Consumer Watchdog.
"The impression you got was, if you just passed this bond measure, Christopher Reeve will be jumping out of his wheelchair and walking next week," said Simpson, referring to the late paralyzed actor who appeared in TV ads backing Prop 71. "They're having to live down the super high expectations that they raised."
Since handing out the first pot of money in late 2006, CIRM has been dogged by questions about its grant-awarding process with critics charging that many of the awards have gone to universities associated with the agency's board. CIRM says all proposals go through peer review and board members with a stake recuse themselves. The institute employs 50 people and has an operating budget of about $18 million.
CIRM suffered a blow last year when Geron Corp. abandoned the stem cell field to concentrate on its lucrative cancer therapies instead. CIRM had loaned the company $25 million to support its spinal cord injury trial, the first embryonic stem cell trial approved in the U.S.
Though Geron paid back the amount spent plus interest, the episode put increased pressure on CIRM to support work with more practical payoff.
David Jensen, who runs the blog California Stem Cell Report, said Californians have benefited, but whether it will be worth the $6 billion the state has to pay back remains unclear.
"The agency's responsibility is now to get the biggest bang for the buck, which is no easy task given the tentative nature of much of the science involved," he said in an email.
Some think CIRM has left a mark whether or not it will exist in the future.
Its "legacy will be felt in part by the stimulus that it has had on stem cell" research in California, said Fred Gage of the Salk Institute for Biological Studies.

Qaeda suspects kidnap Swiss woman in Yemen
Suspected Al-Qaeda militants have kidnapped a Swiss woman and are holding her in the southeastern province of Shabwa, a provincial chief and a security official told AFP on Friday.
"A Swiss woman was abducted in Hodeida (on the Red Sea coast) by armed men who moved her to Shabwa province," the official told AFP on condition of anonymity.
"According to our information, Al-Qaeda is responsible for the abduction," he added.
According to the official, the kidnappers are "demanding the release of two Al-Qaeda militants detained in Hodeida." He gave no further details.
A security official also blamed Al-Qaeda for the abduction.
"The kidnapping bears the hallmark of Al-Qaeda," he told AFP.
According to him, only a well-organised group like Al-Qaeda could have undertaken such an operation, which involved abducting the woman in Hodeida and then moving her across three provinces to Shabwa.
Shabwa is a stronghold of loyalists of the jihadists' local affiliate Al-Qaeda in the Arabian Peninsula, whose militants fight under the banner of Partisans of Sharia (Islamic law).
The Swiss foreign ministry confirmed that a Swiss national was abducted in Yemen, in a statement released on Friday.
The identity of the victim was not revealed but the Swiss foreign ministry said they were informed of the abduction late Wednesday and immediately made contact with competent authorities in Yemen.
Last year, Switzerland urged its citizens in Yemen to leave the country.
In May, the Islamist militants took control of Zinjibar, capital of Abyan province which neighbours Shabwa, as well as several other southern towns, triggering months of deadly fighting with government troops.
More than 200 people have been abducted in Yemen over the past 15 years, many of them by members of the Arabian Peninsula's powerful tribes who use them as bargaining chips with the authorities.
Almost all of those kidnapped were later freed unharmed.
On February 1 four aid workers -- a Colombian, a German, a Palestinian and an Iraqi -- were freed a day after being abducted by armed men northeast of the capital Sanaa. The Palestinian and Iraqi were women.
A Norwegian UN employee, who was abducted by tribesmen in Sanaa on January 14, was released unharmed almost 10 days later.

This was quite a feat given that the idea had towering intellectual credentials. John Maynard Keynes had recommended it in his ?General theory of employment, interest and money?, and a Nobel prize-winner, James Tobin, later developed it.
Before the financial crisis, rather than looking to ?throw sand in the wheels of finance? (to use Tobin's colourful phrase), the story propagated by the industry was that those wheels should spin ever more quickly. We were told that the faster money moved, the more efficiently it would be allocated. Bankers and hedge-fund managers would grow super-rich, but that was a minor distraction because the economy would be stronger and jobs more plentiful.
That story has been rumbled by the financial crisis.
Dynamic economies
Today, FTTs are no longer ridiculed. How could they be? The world's most dynamic economies,?including Brazil, South Korea and India, use them, Europe's most successful large economy, along with eight other EU states, wants to adopt one, and last year approximately $38 billion (?29bn) was raised by FTTs in the 40 countries that have them. Since 1986 (and before in other forms), the UK government has unilaterally, without waiting for others to follow suit, levied a stamp duty reserve tax of 0.50% on transactions in UK equities. Despite not updating this tax to take into account derivatives and other innovations, it still raises around ?3.8bn per year.
The reason why these FTTs work is that they are stamp duties on the transfer of ownership and not based on tax residence. If the transfer has not been ?stamped' and taxes paid, the transfer is not legally enforceable. Institutional investors who hold most assets around the world do not take risks with legal enforceability. Of the UK's receipts from its stamp duty reserve tax, 40%?are paid by foreign residents. Far from sending taxpayers rushing for the exit, this tax gets more foreigners to pay it than any other.?
A negative impact?
Having lost the argument on feasibility, the financial sector and their political friends are now vigorously opposing FTTs with ever more outlandish claims about their negative impact on the wider economy. They have latched on to very preliminary estimates by the European Commission that a 0.1% FTT on equities and bonds could reduce?gross?domestic product?by 1.7%, without waiting for the final analysis.
In its latest iteration, the Commission's model takes into account that the overwhelming majority (85%) of investment comes from retained earnings or bank loans not subject to FTTs. Furthermore, as the Commission's analysis said from the start, the proposed FTTs would only apply to transactions between financial institutions and would not cover companies issuing new shares. Once these factors are taken into account, the Commission's model indicates that the estimated negative effect of FTT on GDP would fall to just 0.1%.
But this is not the complete story. It is necessary to add that the tax would fall most heavily on short-term holders of securities,?such as?high-frequency traders, hedge funds and bank proprietary trading desks. It would fall least on long-term holders?such as?pension funds, life-insurance companies and private equity firms. This would likely trigger a shift away from short-term trading in favour of long-term holding that will reduce misalignments in markets and their subsequent abrupt adjustments or crashes.
Crash course
FTTs would therefore somewhat decrease the likelihood of future crises. Indeed, among those countries that were least affected by the crash, countries with FTTs were disproportionately represented. If we conservatively estimate that the probability of crisis would decrease by only 5% as a result of the FTT, which is very low, and we take into account that on average financial crises decrease gross domestic product (GDP) by around 7%, we would have a positive impact of +0.35% of GDP due to smaller likelihood of future crisis. The total net effect of an FTT would be an estimated boost of Europe's GDP by +0.25%, not a reduction. A more detailed version of this analysis can be found in our recent report presented to the European Parliament.
At a time when many European governments face large deficits, in large part as a result of bailing out the financial sector, it seems reasonable to expect the financial sector to adopt measures to help reduce the likelihood of future crises. To us and hundreds of other economists, the evidence is clear that an FTT adopted by all 27 EU states or by the 17 members of the eurozone would help strengthen Europe's finances and reduce the likelihood of crises.
As the FTT is one of the first international taxes, a proportion of its revenues should be earmarked to finance the solutions to some of the world's most difficult international problems, such as poverty and climate change. Therefore, an FTT could help foster somewhat fairer and more sustainable growth in Europe and globally.

U.N. aid chief seeks access to battered Syrian city
AMMAN (Reuters) - The U.N. humanitarian chief headed Wednesday for a Syrian city where authorities have yet to let a Red Cross aid convoy into a former rebel area amid opposition reports of bloody reprisals by President Bashar al-Assad's forces there.
Valerie Amos had wanted to visit Syria last week, but was denied access. The Syrian military drove armed rebels from the battered Baba Amr district Thursday after a month-long siege and state media say civilians have begun returning there.
The International Committee of the Red Cross has been trying to deliver relief supplies and evacuate the wounded, but has failed to get permission from the authorities so far, raising fears about the fate of survivors in Baba Amr.
Amos left for the battle zones of Homs after meeting Syrian Foreign Minister Walid al-Moualem in Damascus.
He told her Syria was trying to provide food, medical care and services to all citizens despite burdens imposed by "unfair" Western and Arab sanctions, the state news agency SANA said.
Amos is on a three-day mission to try to persuade Syrian authorities to grant unhindered access for aid workers to deliver life-saving assistance to civilians.
Syrian tanks bombarded other opposition areas in Homs overnight, anti-Assad activists said, although an ICRC spokesman in Damascus said the city was quieter than before.
No independent witnesses have been allowed into the devastated Baba Amr district since rebels withdrew.
In the latest of several accounts of killings and other abuses, local activist Mohammed al-Homsi said troops and pro-Assad militiamen had stabbed to death seven males, including a 10-year-old, from one family Tuesday. "Their bodies were dumped in farmland next to Baba Amr," he told Reuters.
Syria imposes severe media restrictions, making such reports hard to verify, although U.N. Secretary-General Ban Ki-moon has voiced alarm at reports that Syrian government forces have executed, imprisoned and tortured people in Baba Amr.
Apart from the shelling of the Homs districts of Karm al-Zeitoun, Jub al-Jandali and Deir Baalba, opposition sources said Syrian troops had staged raids in the towns of Qara and Yabroud north of Damascus, and in the northern city of Aleppo.
MATTER OF TIME
President Barack Obama said it was only a matter of time before Assad left office, but he opposed a call by a senior U.S. senator for American-led military action to force him out.
The world has found no way to halt a year of bloodshed since many Syrians rose against Assad in what has proved one of the longest and bloodiest Arab revolts against entrenched rulers.
At the United Nations, the five permanent Security Council members and Morocco met Tuesday to discuss a U.S.-drafted resolution urging an end to the Syrian government's crackdown on demonstrators, a text some Western envoys said was too weak.
Russia and China, adamantly opposed to any Libya-style intervention in Syria, last month vetoed a draft measure that would have backed an Arab League call for Assad to quit.
According to a text seen by Reuters, the U.S. draft demands "unhindered humanitarian access" and "condemns the continued widespread, systematic, and gross violations of human rights and fundamental freedoms by the Syrian authorities."
Moscow has made clear it has no intention of shifting its position on Syria for the sake of a deal and said it would not support the U.S. draft without changes.
In another effort to stop the violence, former U.N. chief Kofi Annan plans his first visit to Damascus as joint envoy of the United Nations and the Arab League Saturday.
Diplomacy has yet to brake a conflict likely to have cost more than 10,000 lives: the United Nations says security forces has killed well over 7,500 people and Syria said in December that "terrorists" had killed more than 2,000 security personnel.
Assad can still count on powerful allies such as Russia and China, as well as others including Iran, Venezuela and Cuba.
CHINA PLAN
Syria said Wednesday it "welcomed" a Chinese plan brought by envoy Li Huaxin to promote a solution to the conflict.
The plan, unveiled in Beijing Sunday, urges all sides to end violence and cautions against "anyone interfering in Syria's internal affairs under the pretext of 'humanitarian' issues."
Li also met three Syrian opposition leaders whose activities are tolerated by the government.
One of them, Hassan Abdulazim, told Reuters: "We focused on the need to put pressure on the regime and get humanitarian aid to damaged areas in Homs, and the need for China to ... support the Arab League initiative and the United Nations and the international consensus to solve the crisis in Syria."
China is bringing workers home from Syria in an apparent attempt to avoid a repeat of last year's rescue of its nationals from Libya due to violence there.
Air France said it had halted all its flights to Damascus due to worsening security in Syria.
Western leaders have shunned any Libya-style military action in Syria, despite the scale of the bloodletting, fearing an entanglement that could ignite tensions across the Middle East.
The White House said Obama was committed to diplomacy to end the violence, saying Washington wanted to isolate Assad, cut off his sources of revenue and encourage unity among his opponents.
"Ultimately this dictator will fall," Obama said, while rejecting a call by Senator John McCain for a U.S.-led effort to protect Syrian civilians with air strikes on Assad's forces.
"For us to take military action unilaterally, as some have suggested, or to think that somehow there is some simple solution, I think is a mistake," the president said.

Marijuana legalization: Obama opposition too selective
When Latin America talks of legalizing drugs, Obama officials speak up. What about ballot measures in Colorado and Washington Sate to approve marijuana legalization?
Voters in two states, Colorado and Washington, will be asked this November if they want legalization of marijuana. Similar ballot measures are being pursued in a few other states. If approved, these initiatives would mark a dramatic first for America.

Yet two of his closest officials have lately been quite eager to speak out against the mere talk of pot legalization in other countries.
Last month, Secretary of Homeland Security Janet Napolitano told Central American leaders that legalization ?is not the way? to stop drug trafficking. And on a visit to Mexico on Monday, Vice President Joe Biden repeated the message, saying legalization in the region would create more problems than it solves, such as an increase in drug addiction.
These warnings by Obama officials may be aimed at a drive by Guatemala?s president, Otto P?rez, to rally Latin American leaders around the idea of legalizing drugs as a way to undercut the profits of powerful drugs cartels. The conservative ex-general has already gained some support in the region after he first floated the idea in January.
The Obama administration seems to want to dampen the effort quickly. The issue could come up at next month?s Summit of the Americas in Colombia. If so, Mr. Obama may be forced to take a very public stand on legalization just as the 2012 campaign is heating up. During his first presidential campaign, he deflected questions about legalizing cannabis.
Once in office, Obama did eventually launch a crackdown on many dispensaries of ?medical? marijuana in the 16 states that allow such use. The main reason? A lot of the pot, especially in California, was being diverted around the country for resale to recreational users. Meanwhile, the administration only quietly released an official stance against legalization.
During his visit to Central America, Mr. Biden seemed sympathetic to the region?s frustration with drug cartels and their violence. He said a debate over legalization is understandable ?in societies that don?t have the institutional framework and the structure to deal with organized, illicit operations.?
Did the vice president mean to imply that the United States does have the ?institutional framework? to deal with illicit drug sales? If so, why does marijuana use only rise?
The administration needs to step up and make a strong case against legalization in the US in order to counter a well-financed, well-organized pro-marijuana effort. One argument is that the cartels would actually welcome legalization, in the same way that US casino owners have welcomed state gambling lotteries. To drug dealers, the more addicts the better.
Biden did say a debate in Latin America about legalization would help ?lay to rest some of the myths that are associated with the notion of legalization.?
How about he and Obama start to challenge those myths in states like Colorado and Washington?
